SMS/Text Messaging Program Terms

1. Program Name and Purpose

Program Name: OperationWorks Compliance and Task Alert Notifications.

OperationWorks sends automated SMS/text alerts to authorized staff of client organizations about compliance checks, escalations, assigned tasks, due items, work assignments, inspection updates, and related operational alerts. Participation is voluntary. OperationWorks does not send marketing, promotional, advertising, or public solicitation messages through this program.

2. Who Receives Messages

Messages are sent only to authorized employees, staff, home managers, directors, administrators, or other authorized users of organizations that license OperationWorks software and who have opted in to receive SMS/text alerts. Messages are not sent to the general public.

3. How to Opt In

Users may opt in only through an approved opt-in method that clearly explains the program before consent is provided. Approved opt-in methods may include:

Text-to-join opt-in: Text JOIN to 800-299-2521.

In-application opt-in: Enter a mobile number in the user profile or account configuration area and affirmatively select an SMS consent checkbox placed immediately next to the SMS disclosure language.

The following disclosure must appear in immediate proximity to every SMS opt-in form, checkbox, or call-to-action, together with clearly visible links to the Privacy Policy and Terms of Service:

Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to cancel. Consent is voluntary and is not a condition of employment or of using the OperationWorks platform. 4. Confirmation Message

After a user opts in, OperationWorks will send a confirmation message before operational alerts are sent by SMS:

OperationWorks: You are now subscribed to compliance-check, task, work assignment, and inspection alerts for your organization. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel.

5. Message Types

Automated operational alerts may include:

• Required compliance check due or overdue.

• Escalation notice for an overdue compliance check or operational item.

• Assigned task due, overdue, updated, or requiring attention.

• Inspection schedule, inspection update, or inspection follow-up alert.

• Work assignment, due item, or operational workflow notification.

Example message:

OperationWorks: Compliance check for [facility/location] is due by [date/time]. Please log in to OperationWorks to complete it. Reply HELP for help, STOP to cancel.

6. Message Frequency and Rates

Message frequency varies based on the user’s organization, role, assigned tasks, compliance schedules, inspection activity, due items, and operational alerts generated within the applicable OperationWorks deployment. Message and data rates may apply depending on the user’s mobile carrier plan. Mobile carriers are not liable for delayed or undelivered messages.

7. How to Stop Messages

Users may opt out at any time by replying STOP to any OperationWorks SMS/text message. After a STOP request, OperationWorks will send a confirmation message and the user will no longer receive SMS/text alerts unless the user re-enrolls.

STOP confirmation message:

OperationWorks: You have been unsubscribed from compliance-check, task, work assignment, and inspection alerts. No more messages will be sent. Reply START to re-enroll.

8. How to Get Help

Users may reply HELP at any time for program information and support contact details.

9. Re-Enrollment

After opting out, users may re-enroll by replying START, texting JOIN again, or using an approved in-application opt-in method, where available.

10. Privacy and No-Sharing of Mobile Information

Mobile phone numbers are used solely to provide the operational SMS/text alerts described in this section. OperationWorks does not use mobile numbers for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. OperationWorks may share mobile phone numbers, consent records, and message delivery data with its SMS service provider, such as Twilio, only as necessary to deliver, administer, and support the messaging program.

12. Required Placement of Terms and Privacy Links

OperationWorks must keep the Privacy Policy and Terms of Service links clearly visible, accessible, and presented in immediate proximity to each mobile notification opt-in unit, including web forms, in-app profile settings, onboarding screens, printed enrollment materials, and text-to-join calls to action. These links and disclosures must not be hidden solely in a footer, general menu, or unrelated page.

13. Consent Records

OperationWorks may maintain records of SMS/text opt-in, opt-out, HELP requests, START requests, consent source, timestamp, phone number, user account, and related delivery data as needed to administer the program, demonstrate consent, comply with carrier requirements, and honor user choices.
